New Delhi [India], August 1 (ANI): Reacting to the opinion of the Supreme Court that there is a need for identifying creamy layers in SC/STs, AAP MP Sanjay Singh said that the basis of the reservation is not economic status but caste discrimination and social injustice so it should not be seen in the perspective of creamy layer status.
Sanjay Singh said, “Baba Saheb Dr Bhimrao Ambedkar who is considered as highly educated person during his era when he used to sit in a chair the chair used to be washed with Ganga water. The issue of the reservation is not connected with the creamy layer but is linked to social injustice. The basis of reservation to SC/ST and OBC is the discrimination they faced due to their caste.”
Taking a jibe at Uttar Pradesh Chief Minister Yogi Adityanath UP Govt’s Kanwar Yatra directive to display names of owners outside eateries, he said that this was not only to oppress the Muslim minorities but also the Dalits and SC/ST.
“If the name of the hotel is Valmiki dhaba then his hotel will also be shunned. Those who have suffered injustice due to discrimination should get social justice. Those who are in the highest position in the country are spreading hatred in society. When the foundation stone for the Ram temple in Ayodhya was laid then President Ram Nath Kovind was not invited and during the Pran Pratishtha ceremony, President Droupadi Murmu was not invited. In such a situation if social discrimination exists even today then the discussion over creamy layer is redundant,” he added.
The Supreme Court on Thursday opined on the need for identifying creamy layers in SC/STs, as four out of seven judges of the Constitution Bench on Thursday suggested excluding these people from the benefit of affirmative reservation.
Justice BR Gavai expressed his view that the state must evolve a policy for identifying the creamy layer for the Scheduled Castes and Scheduled Tribes (SCs and STs). The suggestion of identifying creamy layers in scheduled castes and scheduled tribes was part of the judgment delivered on Thursday by the seven-judge bench, whereby a majority judgment of 6:1 held that sub-classification within the SC/STs is permissible.
The judgment was delivered by the seven-judge bench led by Chief Justice of India DY Chandrachud, which overruled an earlier judgment in the EV Chinnaiah matter, which held that sub-classification was not permissible because SCs and STs form homogenous classes. (ANI)
